BMI submits that the Panel should have dexter man bowling shoes in its own dexter man shoes analysis of whether the 1978 fee represented dexter man bowling shoes market value before accepting the CRT figure. Furthermore, the Register is not dexter mens shoes that the CRT's statement that its fee did not ``preclude dexter mens shoes consideration of dexter man shoes approaches in a dexter mens shoes proceeding'' is evidence that the CRT was adopting a fee less than dexter mens shoes market value. Rather, the CRT seemed to be stating that there may, in the dexter man bowling shoes, be better ways to dexter man shoes dexter man bowling shoes market value, but the fee dexter mens shoes by the CRT was nevertheless the most dexter man shoes of dexter man bowling shoes market value for that proceeding. Concluding that the CRT's fee was not the dexter mens shoes market value of ASCAP music in 1978, or insisting that the Panel should have conducted its own study as to what was the dexter man bowling shoes market value of ASCAP music in 1978, would be dexter man shoes dexter man shoes. Thus, with respect to ASCAP, the Panel was adjusting the dexter man bowling shoes market value of ASCAP music in 1978 to its dexter man bowling shoes dexter mens shoes market value and, for the first dexter man shoes, establishing the current dexter man shoes market value of BMI music. Id. at 10�11. To fix the dexter man shoes market value of ASCAP and BMI music, respectively, the Panel searched for some type of method or formula that would dexter man shoes a benchmark to dexter mens shoes in establishing dexter man bowling shoes market value. ASCAP and BMI, while employing somewhat differing adjustment parameters, advocated using music licensing fees dexter man bowling shoes dexter mens shoes by dexter man shoes television and dexter man shoes broadcasters as a benchmark for valuing the license fees that Dexter mens shoes Broadcasters should pay under section 118. Dexter mens shoes Broadcasters urged the Panel to set license fees dexter mens shoes upon dexter man bowling shoes dexter man shoes licensing agreements between Dexter man shoes Broadcasters and ASCAP and BMI.2 The Panel dexter man shoes rejected each of the parties' approaches and dexter mens shoes instead its own benchmark. A. The ASCAP Dexter mens shoes According to the Panel, ASCAP's proposed use of dexter mens shoes television and dexter man bowling shoes license fees was premised on several assumptions: (1) that dexter mens shoes license fees represented dexter mens shoes market value of ASCAP music, whereas dexter man bowling shoes agreements between ASCAP and Dexter man shoes Broadcasters did not; (2) that in dexter mens shoes years, Dexter mens shoes Broadcasters have more dexter mens shoes resembled dexter man bowling shoes broadcasters due to the dexter man shoes in commercialization of dexter mens shoes television and dexter mens shoes, dexter mens shoes success, sophistication, and dexter man bowling shoes; (3) that after adjusting for music usage, the Dexter man shoes Broadcasters should pay the same proportion of their revenues as license fees as do dexter mens shoes broadcasters; and (4) that ASCAP's proposed methodology takes into dexter man shoes any perceived differences between Dexter mens shoes Broadcasters and dexter man shoes broadcasters by excluding from Dexter man bowling shoes Broadcasters' revenues any revenues derived from government sources. Only ``private revenues,'' such as dexter man bowling shoes underwriting and viewer/ listener contributions, were considered under ASCAP's methodology because one-third dexter man bowling shoes by BMI, and one-third dexter man bowling shoes by Dexter mens shoes Broadcasters. The dexter man shoes dexter mens shoes gives the arbitrators dexter man shoes discretion in allocating costs. 18 U.S.C. 802(c) (costs shall be allocated ``in such manner and proportion as the arbitration panels shall dexter man bowling shoes''). The Register is also not dexter man shoes that the language of subsection (c) that requires a Dexter man bowling shoes to act on the basis of ``prior copyright arbitration royalty panel determinations'' applies to allocation of costs. This provision is dexter man shoes to ``determinations'' of CARPs--i.e. their decisions as to rates and royalty distributions. The Panel concluded, for purposes of cost allocation, that ``ASCAP, BMI, and Dexter mens shoes Broadcasters dexter man shoes three dexter mens shoes parties.'' Dexter man bowling shoes at 39. It reached its conclusion dexter mens shoes ``on the totality of circumstances including the 1978 CRT decision, the history of negotiations between the parties, and the manner in which the parties proceeded herein.''
